Terms of Service

Welcome to Kobi! These Terms of Service ("Terms") govern your use of the Kobi mobile application ("the App") developed and operated by Fuzzy Logic Gaming Studio ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Kobi, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Kobi for personal, non-commercial purposes. This license is subject to your compliance with these Terms.

This license includes:

• Using the App to generate personalized activity books for your children
• Printing generated PDFs for personal, family use
• Playing Kobi Arcade games for entertainment

4. Account Registration

• A parent/guardian email is required for full features
• You are responsible for maintaining the security of your account
• You must provide accurate information during registration
• You may not share your account with others

• Your Rights: You own the personalized PDFs generated for your personal use
• Personal Use: You may print, share with family, and use generated content for personal purposes
• Restrictions: You may NOT sell, commercially distribute, or resell generated activity books
• Our Rights: We retain ownership of the Kobi brand, mascot, and underlying technology

7. Intellectual Property

All content in Kobi, including but not limited to graphics, Kobi Fox mascot, gameplay, sounds, and code, is the property of Fuzzy Logic Gaming Studio or its licensors and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App or its source code
• Use the Kobi Fox mascot or branding for commercial purposes
• Create derivative works based on the App
• Reverse engineer or decompile the App
• Remove or alter any proprietary notices

8. Subscription and Payments

Kobi may offer subscription plans for premium features:

• Processing: Subscriptions are processed through Apple App Store or Google Play Store
• Platform Terms: Subject to the respective app store's terms and conditions
• Refunds: Generally non-refundable except as required by law or platform policy
• Auto-Renewal: Subscriptions auto-renew unless cancelled before the renewal date
• Cancellation: Manage subscriptions through your app store account settings
• Price Changes: We may change pricing with advance notice

9. Acceptable Use

You agree to use Kobi responsibly and not to:

• Violate any applicable laws or regulations
• Attempt to generate inappropriate or harmful content
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Use the App for any commercial purpose without permission
• Use automated tools to access or scrape the App

10. Privacy and Data

Your use of Kobi is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Key points:

• We never collect photos of your child
• We comply with COPPA, GDPR, and CCPA
• Parent/guardian controls are available

11. Updates and Modifications

We may:

• Update the App to add features, fix bugs, or improve performance
• Modify or discontinue features without notice
• Update these Terms from time to time

Continued use of the App after updates constitutes acceptance of any changes.

12. Disclaimer of Warranties

Kobi is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or completeness of AI-generated content
• Suitability of educational content for specific learning goals

13. Limitation of Liability

To the maximum extent permitted by law, Fuzzy Logic Gaming Studio shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Damages exceeding the amount you paid for the App in the past 12 months
• Inaccuracies in AI-generated educational content

14. Indemnification

You agree to indemnify and hold harmless Fuzzy Logic Gaming Studio from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the App
• Violation of these Terms
• Sharing generated content in ways that violate these Terms
• Violation of any third-party rights

15. Termination

We may terminate or suspend your access to Kobi at any time, without prior notice, for any reason, including breach of these Terms. Upon termination:

• All licenses granted to you will immediately cease
• You may retain previously generated PDFs for personal use
• Your account data will be deleted as described in our Privacy Policy

16. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fuzzy Logic Gaming Studio regarding the use of Kobi.
